Just the Facts: Are Your Medical Records Yours?
A patient's right to gain access to medical records varies according to state law. If your state has no law, it may be possible for you to get copies of your medical records.
- States with laws permitting patients access to medical records in general are AZ, CA, CO, CT, FL, GA, HI, IL, MA, MN, NE, NY, OK, RI, UT, WI. Oregon encourages providers to give access but does not require it.
- States granting access to hospital records only are IN, OH, TN, VA. Louisiana law applies only to state hospitals.
- States that have declared that medical records are confidential (regardless of whether they give patients access to them) are AZ, CA, CO, FL, IL, MA, MN, RI, WI.
