Part of a defence counsel’s role is to follow a client’s instructions while maintaining confidentiality. In many instances defence counsel will be informed by the client of fact and details, admitting to have committed the offense. According to the rules of practice, counsel cannot disclose details unless counsel feels that the accused client will commit a future offence. Would you be able to assume the role of defence counsel in light of the confidentiality rules?
