Chapter Overview

This chapter provides an overview of the legal issues surrounding education. The provisions of the U.S. Constitution that impact education are discussed. The chapter examines parental and state rights with regard to the regulation of education. The constitutional issues related to religion and education are examined. The constitutional rights of parents, students and teachers are explored, as well as limitations that states may place upon these rights. This chapter also explores the constitutionality of corporal punishment and the language rights of non-English-speaking students. The inequities of school financing plans are also addressed.
